AbstractOn 11 December 2007, the Federal Court allowed Jose Hernandez's application for judicial review of a November 2006 decision by the Refugee Protection Division of the Immigration and Refugee Board, which found that the applicant was neither a Convention refugee nor a person in need of protection. Hernandez had requested that the Board's decision be set aside and the matter referred back to a newly constituted panel of the Board for re-determination.
