  • [Legal questions in geriatric medicine-an overview]. [Review]
    HNO 2019Friese KV, Wienke A
  • As a consequence of demographic developments, legal questions regarding medical treatment of the elderly are receiving increasing attention. In the first instance, elderly patients are of course just normal patients. However, they often require a special degree of medical care from physicians and nurses. From a legal perspective, this leads to a heightened level of due diligence from medical prac…
  • [Legal Proxies in Medicine: Representatives and Legal Guardians]. [Journal Article]
    Anasthesiol Intensivmed Notfallmed Schmerzther 2019; 54(7-08):485-494Neitzke G
  • Patients' rights need to be protected, particularly if the patient is unconscious or otherwise unable to consent. According to German law, a legal proxy is mandatory. Spouses and adult children do not automatically function as legal proxies. There are two alternative ways to become a legal proxy: a patient representative (Bevollmächtigter) is authorized by a written power of attorney (Vorsorgevol…
  • Making her end of life her own: further reflections on supporting a loved one with motor neurone disease. [Journal Article]
    Int J Palliat Nurs 2019; 25(6):284-292Harris DA, Jack K, Wibberley C
  • CONCLUSIONS: Dying with MND is a complex phenomenon. When a person can no longer move and communicate, relationships between those involved in end-of-life care are challenging. A person with MND needs the support from those acting as power of attorney to make their end of life their own, and they themselves need support to find meaning in their suffering. This autoethnographic reflection provides vicarious experiences for nurses and other healthcare professionals working with people with MND and similar conditions.

  • All healthcare providers, at some point in their career, will be called upon to go beyond medical decision-making and traverse into the realm of medical ethics. The intersection of medicine and law has provided physicians with tools to guide this process, especially when attempting to make decisions for patients who cannot make decisions for themselves. This field of advance care planning (ACP) h…
  • The Impact of Gliomas on Cognition and Capacity. [Journal Article]
J Am Acad Psychiatry Law 2019Lee J, Hall RCW
  • Brain tumors, particularly gliomas, can have profound effects on cognitive functioning. The cognitive effects that can occur due to a glioma are not just due to the tumor itself, but also from the treatment modalities used. In-depth neuropsychiatric testing or screening is typically necessary to determine the extent of cognitive impairments and the rate of progression, especially given that physi…
  • Advance care planning dispositions: the relationship between knowledge and perception. [Journal Article]
    BMC Geriatr 2019; 19(1):118Cattagni Kleiner A, Santos-Eggimann B, … Seematter-Bagnoud L
  • CONCLUSIONS: Although the direction of the association's causality needs more investigation, results indicate that better knowledge on ACP dispositions could improve the perception older people have of them. Communication on dispositions should take into account individual knowledge levels and address commonly enunciated barriers that seem to diminish with increased knowledge.
